Criminal appeal lawyer Dubai: what to do after a conviction or sentence

If you or a member of your family has been convicted or sentenced, a criminal appeal lawyer in Dubai can read the judgment, tell you whether an appeal is realistic and make sure the deadline is not missed. MBM advises on appeals against conviction and appeals against sentence from our offices in Dubai and Sharjah. Your first consultation is free and confidential. You do not have to work this out alone: we take the legal work off your shoulders, explain each step in plain English and make sure you always know where the matter stands.

A judgment is a frightening document, and it is often in Arabic and hard to read. The most useful thing you can do today is simple: find out the date the judgment was issued and send it to us. Strict deadlines apply, and as we understand it time generally runs from the judgment, not from the day you received the paperwork.

Who we act for

  • The person convicted or sentenced: residents, visitors and business people, whether at liberty, on bail or in custody.
  • Families: relatives or friends acting for someone who is detained, abroad or unable to instruct a lawyer. See for families below.
  • People facing an appeal by the prosecution: where Public Prosecution has challenged an acquittal or a sentence, you also need a lawyer. See appeals by the prosecution.
  • Companies and employers: where a director or employee has been convicted and the business is affected. For the employment side, see employment advice for employers.

Which situation is yours?

Every appeal begins with the same question: what exactly does the judgment say, and what do you want to change? Pick the closest situation below and we will start there. Each one ends with what we check first, so you know what to have ready.

Appeal against conviction

Convicted, want to challenge the verdict

You say the court was wrong to convict, on the law, the procedure or the evidence. First we check: the judgment, the date it was issued, the evidence relied on and any procedural problem at the first hearing. Talk to us about an appeal against conviction

Appeal against sentence

Sentence is too heavy

You may accept the finding but believe the penalty is out of proportion. First we check: the sentence imposed, any additional penalties and the personal circumstances the court was told about. Talk to us about a sentence appeal

Absent defendant

Judgment given in your absence

You were abroad, not served or unaware of the hearing. First we check: how and when you were notified, the date of the judgment and the route that applies to a judgment given in absence. Talk to us about a judgment in absence

Family acting

Relative convicted

You are acting for someone who is detained or cannot instruct a lawyer. First we check: where the person is held, the judgment date, the case number and who holds the papers. Talk to us as a family member

Appeal by Public Prosecution

Prosecution has appealed

An acquittal or a sentence is being challenged. First we check: the appeal notice, the hearing date and what the prosecution says was wrong. Talk to us about a prosecution appeal

Consequences

Travel ban or deportation after judgment

The judgment carries a travel restriction or an order affecting your residence. First we check: whether the order is part of the judgment or an administrative step, and the date it takes effect. Talk to us about travel or deportation after a conviction

Bail and enforcement

Release while the appeal is considered

You or your relative is in custody or about to start a sentence. First we check: the sentence, whether it is being enforced and whether any release option is realistic. Talk to us about bail pending appeal

Appeals explained

What a criminal appeal is, and what it is not

An appeal is a request that a higher court review a judgment because something went wrong, not simply because you disagree with it. If you are searching for how to appeal a criminal case in Dubai, the short answer is that you ask the court above the one that decided your case to look again at the judgment, the case file and the points you raise, within the time the law allows.

The basics in plain English

  • It is a review, not a fresh start. As we understand it, the appeal court generally works from the first-instance judgment, the case file and the grounds put forward. Whether new documents or witnesses can be added depends on the court and the stage, so we confirm that for your case.
  • It needs reasons. An appeal is built on identified grounds. We explain these in the next sections.
  • It does not automatically change anything. Filing an appeal is not the same as winning it. No outcome is guaranteed.
  • It is not always the right move. In some cases a different route, such as settlement with the complainant, a request about the sentence or a review of the consequences, is more useful. We say so honestly.

What an appeal can change

People who search "appeal criminal case" usually want to know what an appeal can actually change. If an appeal succeeds, the appeal court may, depending on the case, confirm the judgment, change the sentence, change the finding or send the matter back for further consideration. We cannot tell you which of these is realistic until we have read the judgment and the file. A short, honest assessment at the start is part of what you get at the first consultation.

Is there any risk in appealing?

Sometimes. Because Public Prosecution can also challenge a judgment in its own right (see appeals by the prosecution), a case that goes to appeal may be looked at again by the court on both sides. Whether that creates a real risk for you depends on the offence and the procedure. We discuss it with you before anything is filed, so the decision to appeal is made with open eyes.

Where your matter will be heard

Dubai Court of Appeal criminal cases: how the court levels fit together

A criminal case in Dubai generally moves up through a small number of court levels, and knowing which level your case has reached tells you what the next step is. This is a general map, not a statement of the exact rules, and as we understand it the details depend on the offence and on which authority has jurisdiction. We confirm the current position at your first consultation.

The court levels in a criminal case, in general terms
LevelWhat it generally doesWhat it means for you
Police and Public ProsecutionInvestigate, question and decide whether to refer the caseThe stage before any judgment; see our criminal lawyer in Dubai page
Criminal court of first instanceHears the case and issues the first judgment; less serious and more serious offences are generally dealt with by different circuitsThe judgment you may want to challenge
Court of AppealReviews a first-instance judgment where grounds exist and the appeal is made in timeThe usual next step after a conviction or sentence
Court of CassationA further level, generally concerned with points of law and procedure rather than a full re-hearing of the factsPossible after an appeal judgment, where grounds exist
Federal Supreme CourtGenerally relevant only to certain federal matters, not to most ordinary criminal cases in DubaiRarely the next step; we tell you if it applies

Court of Appeal in Dubai

The Court of Appeal in Dubai is where most people go first after a first-instance conviction or sentence. It generally reviews the judgment and the case file, hears the parties' arguments and issues its own judgment. After a first-instance judgment, this is the court a criminal appeal lawyer in Dubai will usually be preparing for.

Court of Cassation in Dubai

A further challenge may be possible before the Court of Cassation in Dubai. As we understand it, this level is generally concerned with legal error and serious procedural defects, not with re-weighing the evidence. If your appeal has already been decided, a cassation appeal (a further criminal appeal in the UAE) may be worth assessing. Send us the appeal judgment and its date. Time limits apply at this stage too, and we assess whether any ground is genuinely open before suggesting it.

Is every criminal case appealable?

Not necessarily. As we understand it, the right to appeal and the route can depend on the type of offence, the court that decided it and whether the judgment was given in your presence or in your absence. We tell you at the start whether an appeal is available in your case, and if it is not, whether anything else can be done.

Grounds

Grounds of appeal in a criminal case

A criminal appeal needs identified reasons, and the strongest appeals are built around a small number of clear points, not a long list of complaints. The grounds of appeal in a criminal case generally fall into four families. Which of them, if any, are open to you depends entirely on the judgment and the file.

Law

Legal error

The court applied the wrong law, misread a provision or reached a conclusion the law does not support. First we check: the charge, the legal basis the judgment relies on and whether a later change in the law may be relevant.

Process

Procedure

A step the law requires was missed or done wrongly: notice of the hearing, access to the file, the way a statement was taken or the way the hearing was run. First we check: the case file, the hearing record and what you were told and when.

Facts

Evidence

The conviction rests on evidence that is weak, inconsistent, wrongly admitted or wrongly assessed, or relevant evidence was not considered. First we check: the evidence the judgment relies on, the reports and statements, and what the defence put forward at first instance.

Penalty

Sentence

The penalty is out of proportion to the offence, ignores relevant circumstances or includes an additional penalty that should be reconsidered. First we check: the sentence and any additional penalties, the range the offence generally carries and your personal circumstances.

Appeal against conviction in the UAE

An appeal against conviction in the UAE argues that the court should not have convicted at all, or should not have convicted of that offence. That usually means one or more of legal error, procedure or evidence. We read the judgment line by line, compare it with the case file and tell you which points we think are real and which are unlikely to help.

Appeal against sentence in Dubai

An appeal against sentence in Dubai accepts, at least for the purposes of the appeal, that the conviction stands, and argues that the penalty should be lower or different. This can include the length of a sentence, a fine, an additional penalty or a consequence such as deportation, depending on what the judgment orders. A sentence appeal can also be combined with a challenge to the conviction.

Can a criminal conviction be overturned in the UAE?

It can happen, but nobody can promise it, and we will not. Whether a criminal conviction can be overturned in the UAE depends on whether there is a genuine ground, how strong the point is and what the appeal court decides. A conviction that rests on a clear legal error or a serious procedural failure is in a different position from one where you simply disagree with the court's view of the facts.

What rarely helps

  • Disagreeing with the verdict without identifying a specific error.
  • Raising new arguments that were not put at first instance, without a reason they can be heard now.
  • Relying on promises from someone who says they know the judge or can arrange a result.
  • Waiting to see whether the sentence will actually be enforced before getting advice.
Time limits

Deadlines: why you should send us the judgment date now

Strict deadlines apply to criminal appeals, and as we understand it they generally run from the date of the judgment, not from the date you learned of it or received a copy. We do not state a number of days here because the period can depend on the type of judgment and the court, and requirements change, so we confirm the current position at your first consultation. What we can say firmly is this: the earlier you send us the judgment date, the more room there is to prepare a proper appeal.

Do not wait for the paperwork. If you know a judgment was issued, tell us the date today. We can start working out the time limit from the date alone, and we can ask for the full judgment and file while the clock is running. A missed deadline can close the appeal route, and it is the one problem that careful preparation later cannot fix.

What affects the deadline

  • The type of judgment. A judgment given in your presence and one given in your absence may follow different routes and different time rules.
  • The level of court. The period for a first appeal and for any further challenge can differ.
  • The party appealing. The defendant and Public Prosecution may each have their own rights and time limits.
  • How the judgment is counted. The date the judgment is issued, the date it is announced and the date you are notified are not always the same, so the exact counting needs to be confirmed against the papers.

What if I think the deadline has already passed?

Tell us anyway. There may be a route that does not depend on the same deadline, such as a different type of challenge, a request about enforcement or a request about the consequences of the judgment. We tell you plainly if the main route has closed and what, if anything, remains.

Our first review

What we review first

Before we advise on whether to appeal, we read three things: the judgment, the case file and any translation. Most of an appeal is decided by what these documents actually say, so this review comes before any promise or plan.

  1. Step 01

    The judgment

We read the full judgment, including the charge, the finding, the reasons, the sentence and any additional penalty, and we note the date and the court.

  2. Step 02

    The case file

We look at the statements, reports, evidence and hearing records, and compare them with what the judgment says the court relied on.

  3. Step 03

    Translation

Court papers are generally in Arabic. Where you need a translation of the judgment or the file, we help arrange a certified one and explain what it says in English.

  4. Step 04

    The deadline

We work out the time limit from the judgment date and record it, so the deadline is protected before anything else.

  5. Step 05

    Custody, bail and enforcement

We establish whether the sentence is being enforced, whether the person is in custody or on bail, and what release options may exist.

  6. Step 06

    Travel and residence

We check for a travel ban, a deportation order or a residence consequence, and how it interacts with the appeal.

While the appeal is considered

Bail pending appeal, suspended sentences and enforcement

What happens to the person while an appeal is considered is often the most urgent question for a family. The honest answer is that it depends on the offence, the sentence and the court, and that no release is ever certain. This section is an outline, and requirements change, so we confirm the current position at your first consultation.

Bail pending appeal in the UAE

As we understand it, release pending appeal may be possible in some cases and on conditions, such as a financial security, a passport hold or a guarantor, but it is a decision of the court or authority and it is not automatic. The sentence, the offence, the person's ties to the UAE and the strength of the appeal can all matter. A lawyer cannot buy release; a lawyer puts the proper case for it. For more on release in general, see our page on bail, travel bans and Interpol.

Suspended sentence in the UAE

A suspended sentence is one where the court orders a penalty but does not require it to be served straight away, generally on conditions. As we understand it, this is available only in limited circumstances, depending on the offence and the sentence. If your judgment includes a suspended sentence, the conditions matter as much as the length, because breaking them can bring the penalty back. If it does not, we can advise on whether it may be something to ask for on appeal.

Stay of sentence while the appeal is considered

Whether lodging an appeal pauses the enforcement of a particular sentence depends on the sentence and on what the court orders, so do not assume that an appeal stops the sentence. We establish the enforcement position early, and we tell you whether an application about enforcement is realistic. Fines and additional penalties may follow different rules from custodial sentences.

What we handle on release and enforcement:

  • Establishing whether the sentence is being enforced and from when.
  • Advising on whether bail pending appeal is realistic and on the conditions that could apply.
  • Reading the conditions of any suspended sentence before they are accepted.
  • Keeping the family informed about what is happening and what to expect.
Travel and residence

Travel ban and deportation after a conviction

A criminal judgment often carries consequences beyond the sentence itself, and for people who are not UAE nationals those consequences can matter as much as the penalty. We look at them alongside the appeal, not afterwards.

Travel ban after conviction in the UAE

A travel ban after conviction in the UAE can be attached to the criminal matter itself, for example while a case or an enforcement step is outstanding. Some bans come instead from an unrelated civil or financial matter. The first task is always to identify what the ban is attached to. See our page on a travel ban lawyer in Dubai, and for the wider picture of bans, notices and release, bail, travel ban and Interpol. If the ban comes from a debt or civil judgment, see debt recovery.

Deportation after conviction in the UAE

A criminal conviction can carry immigration consequences for non-nationals, including the possibility of a deportation order, depending on the offence and the person's circumstances. As we understand it, deportation orders may be judicial, meaning part of the court's judgment, or administrative, meaning issued by a separate authority, and the route to challenge them differs. If the order is part of the judgment, it may be addressed in the appeal. If it is administrative, it is generally challenged through the authority that issued it. Time can matter, so do not wait to see whether it is enforced. For administrative challenges more generally, see administrative law.

Residence, work and family

A conviction can affect a residence permit, a job, a lease and a bank account at the same time. We tell you straight away if we think the realistic aim is to manage the effects, not to cancel them, and we coordinate the criminal appeal with the immigration and employment questions.

Public Prosecution

Appeals by the prosecution

An appeal is not only something a defendant can bring. As we understand it, Public Prosecution can generally challenge a judgment too, for example an acquittal, or a sentence it considers too lenient. If you have been acquitted or received a lighter sentence than expected, an appeal notice from the prosecution can be a surprise.

If the prosecution has appealed your case

  • Do not assume the case is over just because the first judgment was in your favour.
  • Keep the appeal notice and the hearing date, and send both to us promptly.
  • Do not contact witnesses or the complainant yourself; let a lawyer handle any approach.
  • Do not leave the country without advice if there is any risk of a restriction.

What we handle on a prosecution appeal:

  • Reading the notice and establishing what the prosecution says was wrong.
  • Preparing the defence response to the appeal.
  • Representing you at the appeal hearings, where we are instructed.
  • Advising on the effect on travel, bail and residence.
Other routes

Sentence reduction, reconciliation and pardon

An appeal is one route. Depending on the offence and the stage, a few other routes may sit alongside it, and some of them are quicker or more realistic. As we understand it, each depends on the offence, on whether a private complainant is involved and on the stage the case has reached.

Sentence reduction

A sentence reduction can be sought through an appeal against sentence, or in some circumstances through a different application after judgment. It generally turns on the sentence imposed, the personal circumstances, the conduct since the judgment and what the law allows for that offence. We tell you whether we think a reduction is a realistic aim before you commit to it.

Reconciliation and settlement

Where an offence involves a private complainant, a settlement with that person may sometimes be relevant, including in some cases after a judgment, depending on the type of offence. As we understand it, a settlement can in some categories lead to a complaint being withdrawn or a penalty being affected, but it is not available for every offence and it does not always end the case. Never make a payment or sign an agreement with the other side without advice. Any settlement should be written down and checked first.

Pardon in the UAE

A criminal pardon in the UAE is a decision of the state, not something a lawyer or an intermediary can arrange or buy. As we understand it, pardons and similar releases are granted by the authorities in their discretion and often on particular occasions, and they generally cannot be requested as of right. We can advise on whether there is a proper route to raise your case, and on what to prepare. We never promise a pardon, and you should not pay anyone who does.

For families

For families acting for a detained relative

If your relative has been convicted and is in custody, or is abroad and cannot instruct a lawyer, you can call us. "My relative was convicted in Dubai" is one of the most common reasons families contact us, and the first call is usually about the same few things: where is the person held, what does the judgment say and how long do we have.

What we need from you

  • The person's full name, nationality and, if you know it, where they are held.
  • The date of the judgment, the court and the case number if you have them.
  • A copy or photograph of the judgment, even if you cannot read it.
  • Who the previous lawyer was, if there was one, and whether they still hold the file.
  • What the person has told you about the sentence and any release conditions.

How we work with families

We take instructions from a family member where the person cannot instruct us directly, and we explain the position to the person concerned as soon as we can. We tell the family honestly what is known and what is not, in plain English, and we do not promise results. Where the person is a foreign national, you may also wish to contact their embassy or consulate, which cannot act as a lawyer but may explain what support it offers.

If the person has just been sentenced. Call +971 4 570 0204 as early as you can or send the judgment date and basic facts by WhatsApp. Say who the person is, where they are held if you know and which court gave the judgment.

How it works

How MBM handles a criminal appeal, step by step

Every appeal starts with a short conversation and a careful read of the papers, and then a clear explanation of the options before any step is taken. The path below is how we approach it. It is a map, not a prediction, because the details depend on the case.

  1. Step 01

    Free first consultation

Your first consultation is free and confidential. You tell us what you know, even if it is incomplete, and above all the judgment date. We explain where you stand.

  2. Step 02

    Secure the deadline

We work out the time limit from the judgment date and record it, so that nothing else delays the filing.

  3. Step 03

    Review the judgment and file

We read the judgment, the case file and any translation, and identify the grounds that are real.

  4. Step 04

    Written assessment, scope and fee

We tell you honestly whether an appeal is worth pursuing and what the risks are. If you instruct us, we give you a written scope and fee before paid work starts.

  5. Step 05

    Prepare and file

We prepare the grounds and the supporting material and file the appeal within the time allowed, where you instruct us to.

  6. Step 06

    Hearings and representation

We represent you before the appeal court where we are instructed, and keep you or your family updated at each stage.

  7. Step 07

    Judgment and next steps

We explain the appeal judgment, and advise on any further challenge, on enforcement and on the effect on travel and residence.

Timelines: what we can and cannot say

We cannot tell you how long your appeal will take, and anyone who gives you a precise date without reading your file is guessing. As we understand it, the time depends on the court's workload, the complexity of the case, whether the person is in custody and whether further steps are needed. What we can promise is that you will always know where the matter stands, and that we will tell you at each step what happens next and roughly what to expect.

Avoid these

Common mistakes to avoid after a judgment

Stress and confusion lead to avoidable errors in the days after a judgment. These are the most common, and each can usually be avoided.

  • Waiting for the full judgment before calling anyone. The clock may already be running. Tell a lawyer the date first.
  • Assuming the previous lawyer is still acting. A lawyer at first instance is not automatically instructed to appeal. Confirm it in writing.
  • Paying someone who promises a result. Judgments and pardons are decided by the courts and the authorities. Do not pay anyone who says otherwise.
  • Signing a settlement or a document you cannot read. Get it checked and translated first.
  • Trying to leave the country. A conviction or an outstanding sentence may carry a travel restriction. Get advice before going to the airport.
  • Ignoring a fine or a condition. Breaking the terms of a suspended sentence or a release can create a new and separate problem.
  • Deleting messages or files. Deleted material can create a separate problem. Keep originals.
Before you call

Documents for a criminal appeal

You do not need any of this to make the first call. If a judgment has just been issued, call first with the date and gather documents afterwards. Whatever you have is useful, even if it is incomplete or in Arabic.

  • The judgmentA copy or a photograph of every page, with the date it was issued and the court that issued it.
  • The case or file numberFrom the court, Public Prosecution or the police.
  • The charge or referralThe Public Prosecution referral or charge sheet, if you have it.
  • Details of the sentenceLength, fines, additional penalties and whether the person is in custody, on bail or at liberty.
  • Passport, Emirates ID and visa detailsResidence status matters for travel and deportation questions.
  • Any translation of the judgmentAn existing translation helps, but we can arrange a certified one if you do not have it.
  • Your first-instance lawyer's detailsIf there was one, and whether they hold the case file.
  • Evidence and correspondenceStatements, reports, messages, cheques, contracts and anything else relied on at first instance. Keep originals as they are.
Why MBM

Why MBM for a criminal appeal

An appeal asks for care, honesty and speed at the same time, and we organise our work around that. Here is what you can expect from MBM, whether you come to us in Dubai or in Sharjah.

Rated 4.9 on Google reviews. MBM is a founder-led team, led by Mohamed Badr with 17 years of legal experience, with litigation and arbitration handled by the same team and offices in Dubai and Sharjah. For an appeal, that means a confidential first call, a plain explanation of where you stand and a written scope and fee before paid work starts. MBM works with group companies in the UK, Europe, the Middle East and the Gulf, which helps when a matter has an international side.

We start with the deadline

The first thing we do is work out the time limit from the judgment date, because everything else depends on it.

Straight answers about the merits

A good appeal lawyer tells you where the case is weak as well as where it is strong. If we think an appeal is unlikely to help, we say so and tell you what else may be worth doing.

Families can instruct us

We can act on a family member's instructions where the person affected cannot instruct us directly, and we explain the position to the person concerned as soon as we can.

Confidentiality as standard

Criminal matters are sensitive. Confidentiality applies from the first phone call, not from the engagement letter.

Litigation and arbitration handled by the same team

MBM handles litigation and arbitration as one team, which matters when a criminal case has a civil or commercial side, such as a bounced cheque or a debt behind a travel ban. See our civil lawyer and court representation pages, and for the fraud side, financial crime.

No promises on outcome

No responsible firm can promise that a conviction will be overturned, a sentence reduced or a release granted. We tell you the realistic position before you commit.

Fees

How fees work

Your first consultation with MBM is free and confidential. If you decide to instruct us, we give you a written scope and a fee position before paid work starts, so you know what is covered and what is not.

Court fees, translation costs and other third-party charges depend on the case and are separate from legal fees, and we explain which are likely to apply in your case. Because every judgment and every file is different, we do not publish a price list or a fixed figure for an appeal. Ask at your first consultation and we will answer directly. If a family member is paying on behalf of someone who is detained, say so on the first call.

Common questions

Criminal appeals in the UAE: your questions answered

General information about criminal appeals in Dubai and the UAE. It is not legal advice. Requirements change, every case depends on its own facts and the judgment itself, and we confirm the current position at your first consultation.

How do I appeal a criminal judgment in Dubai?

You ask the court above the one that decided your case to review the judgment, within the time the law allows. In practice that means identifying the grounds, preparing the appeal and filing it in time. The steps depend on the offence and the court, so send us the judgment date and a copy of the judgment and we will explain the route for your case. Your first consultation is free.

How to appeal a criminal case in Dubai if I have not got the full judgment yet?

Tell us the date the judgment was issued first, and the court if you know it. We can work out the time limit from the date, and ask for the judgment and the file while the clock is running. Do not wait to hold every paper before calling.

What is the time limit to appeal a criminal judgment in the UAE?

Strict deadlines apply, and as we understand it they generally run from the date of the judgment. The exact period depends on the type of judgment and the court, and requirements change, so we confirm the current position at your first consultation. Send us the judgment date now.

Can a criminal conviction be overturned in the UAE?

It can happen, but it depends on whether there is a genuine ground, such as a legal error, a procedural failure or a problem with the evidence, and on what the appeal court decides. MBM cannot promise that any judgment will be reversed. We read the judgment and the file first and tell you honestly what we think.

What are the grounds of appeal in a criminal case?

In general terms, grounds of appeal in a criminal case fall into legal error, procedure, evidence and sentence. The strongest appeals identify a small number of clear points. Which are open to you depends on the judgment and the case file.

Can I appeal against sentence in Dubai if I accept the conviction?

In some cases an appeal can be directed at the sentence alone, arguing that the penalty is out of proportion or ignores relevant circumstances. Whether that is realistic depends on the offence and the sentence imposed. We will read the judgment and advise.

Is bail pending appeal in the UAE possible?

As we understand it, release pending appeal may be possible in some cases, on conditions, but it is a decision of the court or the authority and is never automatic. It depends on the offence, the sentence and the circumstances. See our page on bail, travel bans and Interpol.

What is a suspended sentence in the UAE?

A suspended sentence is a penalty the court orders but does not require to be served straight away, generally on conditions. As we understand it, it is available only in limited circumstances, depending on the offence and the sentence. If you have one, read the conditions carefully, because breaking them can bring the penalty back.

Does an appeal stop the sentence being enforced?

Not always. Whether lodging an appeal pauses enforcement depends on the sentence and on what the court orders, so do not assume it does. We establish the enforcement position early and tell you whether an application about it is realistic.

Can Public Prosecution appeal an acquittal or a sentence?

As we understand it, Public Prosecution can generally challenge a judgment, including an acquittal or a sentence it considers too lenient. If you have received an appeal notice from the prosecution, send us the notice and the hearing date. See appeals by the prosecution.

Can I be deported after a conviction?

A conviction can carry immigration consequences for non-nationals, including the possibility of deportation, depending on the offence and the circumstances. As we understand it, a deportation order may be judicial, as part of the judgment, or administrative. See bail, travel ban and Interpol for more on deportation orders.

Can deportation after conviction in the UAE be challenged?

In some circumstances there may be a route to challenge or seek reconsideration of a deportation order, depending on its legal basis and the stage reached. If the order is part of the judgment, it may be addressed in the appeal. If it is administrative, it is generally challenged through the authority that issued it. Do not wait to see whether it is enforced.

Will I have a travel ban after conviction in the UAE?

A conviction or an outstanding sentence can be connected to a travel restriction, but not always, and a ban can also come from a civil or financial matter. The first step is to establish what the ban is attached to. See our travel ban lawyer in Dubai page.

Can a pardon or reconciliation reduce a sentence?

As we understand it, in some categories of offence a settlement with a private complainant can affect a complaint or a penalty, and pardons are discretionary decisions of the authorities. Neither is available for every offence, and neither can be bought through an intermediary. We advise on whether a proper route exists in your case and never promise a result.

My relative was convicted in Dubai. What can I do?

Call us with the judgment date, the court, the person's name and where they are held, if you know. A family member can instruct us when the person cannot, and we explain the position to the person concerned as soon as we can. See for families above.

Can a family member instruct a criminal appeal lawyer in Dubai for a detained relative?

Yes. We can take instructions from a family member or another contact and explain the position to the person concerned. Where the person is detained, say so on the first call, and tell us who is paying if it is not the person affected.

What documents do I need for a criminal appeal?

The judgment, the case number, the date and court, details of the sentence, passport and residence details and, if you have them, the charge, the first-instance lawyer's details and any translation. You do not need all of these to make the first call. See documents for a criminal appeal.

How long does a criminal appeal take in Dubai?

There is no honest single answer. It depends on the court's workload, the complexity of the case, whether the person is in custody and whether further steps are needed. We tell you at each stage what happens next and roughly what to expect, without promising a date.

Is the Court of Cassation in Dubai a second appeal?

As we understand it, a further challenge may be possible after the appeal judgment, but at that level the Court of Cassation in Dubai is generally concerned with legal error and serious procedural defects, not with re-weighing the evidence. Send us the appeal judgment and its date and we assess whether any ground is genuinely open.

What if the judgment was given in my absence?

A judgment given in your absence may follow a different route and different time rules from one given in your presence. Tell us how and when you were notified, the date of the judgment and where you are now. Do not travel into the UAE before taking advice if you think a judgment or warrant may exist.

What are criminal appeal lawyer fees in Dubai?

We do not publish a fixed figure, because every judgment and file is different. If you decide to instruct us, we give you a written scope and a fee position before paid work starts, and we explain which court fees and translation costs are separate.

Is the first consultation really free?

Yes. MBM's first consultation is free and confidential. It is a discussion of your situation and your options. If you then choose to instruct MBM, we confirm the scope and the fee in writing before any paid work starts.

Can MBM promise that my appeal will succeed?

No. No responsible law firm can promise the outcome of an appeal. MBM's role is diligent, strategic representation based on the judgment, the file and the applicable law, and straight answers about the merits before you commit.

Can MBM take over from my previous lawyer?

Often yes. Send us the judgment, the date and the name of the previous lawyer, if there was one. We help establish who holds the file and what has already been done, and we tell you what we need before we can act.

I was convicted of a bounced cheque or a drug offence. Can I appeal?

The same general approach applies, but the rules for each offence are specific, so we read the judgment first. See bounced cheque cases, drug cases and financial crime.

Is my consultation about a criminal appeal confidential?

Yes. MBM treats every consultation and engagement with professional confidentiality, whether the matter is at the enquiry stage or already before the courts.
