Debt settlement lawyer Dubai: help for borrowers and debtors

A debt settlement lawyer in Dubai helps you deal with money you owe: a bank loan, a credit card, a business facility or a personal debt. We read what you signed, what the lender says you owe and what has been served on you, and then we help you choose between settling, rescheduling, defending or a mix of these. You do not have to work this out alone. We take the legal work off your shoulders, and you will always know where your matter stands. Your first consultation is free and confidential.

This page is written for the borrower's side. If you are the one who is owed money, see our debt recovery lawyer page instead. If you are arranging or restructuring finance before anything has gone wrong, see our banking and finance lawyer page. MBM acts on both sides of debt matters, so we know how a claim is built and how it is answered.

Who we act for

  • Individuals: borrowers with a personal loan, car finance, an overdraft or a credit card they can no longer keep up with, including residents and people who have left the UAE and are worried about a case.
  • Business owners and self-employed people: owners whose business facility is behind, often with a personal guarantee or personal cheques behind it.
  • Companies: businesses in difficulty with a bank or other lender. We act for companies in free zones, the DIFC and the ADGM as well as on the mainland.
  • Guarantors and co-borrowers: people who signed for someone else's loan and are now being asked to pay.
  • Families: a relative can call us on your behalf, and we explain what we need from you to act.

Loan default

Loan default lawyer Dubai: when you cannot keep up with repayments

A loan default lawyer in Dubai helps you decide whether to settle, reschedule or defend, and in what order, before the lender takes the next step. Most borrowers first ask what happens if they default. The honest answer is that it depends on the loan agreement, the lender, the amount and how long the problem has lasted, so we start with the documents, not with guesses.

Missing a payment and being in default are not always the same thing. The agreement says what counts as a default, whether you have a chance to put it right and what the lender may do next. So any question about a loan default in UAE law starts with the contract you signed.

Bank loan default lawyer Dubai: what the bank may do

It helps to know the stages a lender usually moves through. As we understand it, a lender that is owed money can seek a payment order and then enforcement through the execution process. Lenders commonly begin with reminders and a formal demand, and what follows depends on the agreement and on the lender's own approach.

What can follow a missed payment, in general terms
StageWhat it usually looks likeWhat we check
Reminders and callsMessages, calls and letters about the missed instalmentsWhether the amount and dates are right, and what you have said or signed
Formal demand or default noticeA letter or notice that treats the loan as in defaultWhat the agreement says about default, notice and any chance to remedy it
Claim or payment orderThe bank files a case or applies for a fast-track orderThe date it reached you, the amount and the documents behind it
ExecutionA judgment or order is enforced against youWhat has been listed, and whether a recorded settlement is possible

Not every case goes through every stage, and some settle early. The earlier you take advice, the more of these stages may still be open to you.

Personal loans, car finance and overdrafts

For an individual, the usual starting point is the agreement, the statement and any cheques given to the bank when the loan was arranged. Cheques or other instruments given as security can create exposure of their own, so we ask what happens to them if the loan is settled or rescheduled.

What we handle:

  • Reviewing the agreement, the statement and the default notice.
  • Negotiating a written settlement, instalment plan or rescheduling with the lender.
  • Defending a claim where the amount or the basis is wrong.
  • Dealing with cheques and guarantees linked to the loan.

Company loan default Dubai: business facilities

A company loan default in Dubai usually involves more than the company: security over assets, personal guarantees from owners and cheques signed by directors. We map who is exposed to what before talks begin. See company debt and personal liability below. For a business that sees a covenant or repayment problem coming, see restructuring before default.

Interest, fees and charges in general terms

The balance a bank asks for is usually more than the amount you borrowed. Interest or profit, late fees and other charges are added under the agreement, and some Islamic finance products describe the cost as profit and not interest. We ask for a full statement and compare it with the contract. Whether any part of the balance can be questioned depends on the agreement and the law, and we do not promise that any amount will be reduced.

When a default can be disputed

In some circumstances a borrower can dispute a declared default, for example where the default is disputed on the facts or where the lender's own conduct is in question. We start with the agreement, the notice, the payment history and the correspondence, and tell you honestly whether there is something to argue. If there is not, we turn to the terms of settlement you can realistically reach.

Cannot keep up with a loan? Talk to us before a missed payment becomes a claim. Your first consultation is free and confidential.

Credit cards

Credit card debt lawyer Dubai: card default and settlement

A credit card debt lawyer in Dubai deals with the bank on your behalf, checks how the balance was built and negotiates a settlement you can meet. People often search "credit card default UAE" once the calls start. Most of these debts start small and grow through charges, so the first job is to see the real figure and who is claiming it.

If you are unable to pay credit card balances on time, do not ignore the statements or let calls go unanswered without a plan. A written approach from a lawyer often changes the tone of the conversation, and it keeps a record of what you offered and when.

Credit card settlement UAE: what a written settlement should say

Credit card settlement in the UAE is a negotiation, and the bank decides what it will accept. Whatever is agreed, it should be in writing and it should answer the same questions each time.

  • Which debt does it cover? The card or cards, the account number and the balance on a stated date.
  • Is it full and final?Wording that says when the account is settled and that nothing further is owed.
  • How and when is it paid? One payment or instalments, the dates and what happens if one is missed.
  • What happens to cheques and cards?Return or cancellation of any cheque you gave, and closure of the account.
  • What will the bank confirm?A written confirmation that the account is closed once the agreed payments are made.

How to settle credit card debt in UAE: the usual order

There is no single answer, but the order of work is usually the same:

  1. Get a full statement and the card agreement, and check the balance against them.
  2. Find out whether anything has been filed, and note every date.
  3. Decide what you can genuinely pay, now or by instalments.
  4. Put a proposal in writing to the bank, through us if you prefer.
  5. Do not pay anything until the terms are in writing and you know what the payment settles.

What we handle:

  • Reviewing the card agreement and statements.
  • Negotiating a lump-sum or instalment settlement in writing.
  • Responding to a claim, a payment order or a collector.
  • Getting written confirmation that the account is closed once the settlement is paid.
Settlement

Debt settlement in Dubai: settling, rescheduling and restructuring

Debt settlement in Dubai means reaching a written agreement with the lender about how a debt will be dealt with, and the lender decides what it will accept. A lawyer cannot make a bank agree. What a lawyer can do is prepare the ground, put a credible proposal in writing and make sure that what is agreed is what is recorded. People often search "debt settlement UAE" once the letters start, and timing matters: a settlement works best when talks start before an enforcement file exists, although it can still be possible afterwards.

Settlement routes compared, in general terms
RouteWhat it isWhen it may fitPoints to watch
Lump-sum settlementOne payment to close the debt on agreed termsYou can raise a sum and the lender prefers certaintyThe wording must say the debt is closed once it is paid
Instalment planA schedule of payments over an agreed periodYou have a regular income but cannot clear the balance at onceWhat happens if one instalment is missed, and whether enforcement is paused
ReschedulingThe loan stays, but its payment dates or terms changeA temporary problem, or a lender willing to extend the termWhether the new terms replace the old default provisions
RestructuringA wider change to the facility, security or several debts togetherLarger or business debts, or debts with more than one lenderDiffering lender interests, and any security or guarantees that stay in place
Court-supervised proceduresProcedures UAE law provides for companies in financial difficultyWhere informal talks are not enough. See company debtAvailability depends on the company and where it is established

Nobody can promise a particular settlement figure or that a lender will accept a proposal, and we do not. What we can promise is that you will know what is being proposed, what it does to your position and what you give up in return.

Debt negotiation lawyer Dubai: how we negotiate

We negotiate from the numbers and the documents, not from pressure alone. We ask for a full statement, check it against the agreement, test what you can genuinely pay and put a proposal in writing. We keep the offer and every reply on record, so that the file shows what was agreed. If the lender does not move, we tell you whether a defence, a different proposal or a different route is the sensible next step.

Loan settlement Dubai: closing a loan early or on new terms

Loan settlement in Dubai can mean paying off a whole loan early or agreeing different terms for what remains. For early loan settlement, the agreement usually says how the amount to close is worked out and whether any early settlement charge applies, so we read it first. Searches for "bank loan settlement UAE" usually come from borrowers who want to close a loan early. Whatever is agreed should end with a written statement of the closing amount and, once paid, a written confirmation that the loan is closed and any cheques or security have been released.

Debt rescheduling UAE and loan rescheduling Dubai

Debt rescheduling in the UAE and loan rescheduling in Dubai are the lighter options: the debt stays, but the timing changes. They suit people with a temporary problem. The agreement should say clearly that the new terms replace the old ones, and that a missed payment under the new schedule has defined consequences. An informal promise on the phone is not enough.

Debt restructuring lawyer Dubai: individuals and businesses

A debt restructuring lawyer in Dubai helps you renegotiate repayment terms, security or the facility itself, as a constructive alternative to default. What people search for as "bank loan restructuring UAE" is more common for businesses and for borrowers with several debts, and it needs a realistic plan the lender can follow. For the business side of restructuring in more detail, see banking and finance lawyer in Dubai.

Bank claims

Bank suing me Dubai lawyer: when the bank files a claim

If your bank has filed a claim against you, the immediate priority is the deadline and the merits. "Bank suing me in UAE" is how many people search for it, and it can feel final, but a claim is not the same as a debt you owe: the amount has to be shown, and the documents have to establish it. Banking claims are often well documented, so early advice matters.

Bank case against me in Dubai: what you will receive and what to do

Start with the papers. Read what has been served, note the date it reached you, and write down every date it contains. A court notice, a claim, a payment order and an execution notice are four different things with four different next steps.

  1. Step 01

    Read and diary the papers

We note every date on what was served and work out which stage you are at.

  2. Step 02

    Test the claim

We compare the amount with the agreement and your payment records, and ask whether the documents prove what the bank says they prove.

  3. Step 03

Decide between defence, settlement or both

A defence and a settlement can run side by side, and an early offer may be worth making while a deadline is protected.

  4. Step 04

    Respond within the deadline

A response must be prepared properly and in time. A point raised late or without evidence may not count.

  5. Step 05

    Record the outcome

A judgment, a settlement or a withdrawal should be confirmed in writing, including what happens to any freeze, cheque or guarantee.

Payment order served on me: what to do

A payment order is a fast-track route for a creditor who holds clear written proof of a debt. If a payment order has been served on you, the window to respond is short and it runs from service, so the date it reached you matters. We do not give a period here, because it depends on the type of order and the current law, and the papers you received should say what applies. Call us at once so that the deadline is protected while the merits are checked.

Payment order objection lawyer Dubai: what an objection looks at

An objection comes down to two things: getting the response in on time, and making sure it raises the right points. The right way to object depends on the order and the grounds, and a point that is not raised properly and in time may not count. The points we usually test are:

  • Whether the debt is owed at all, or is someone else's.
  • Whether the amount is overstated, including interest and charges.
  • Whether you have already paid something that is not shown.
  • Whether the documents actually establish the debt as claimed.

What we handle:

  • Diarising the deadline and filing within it.
  • Checking the amount against the agreement and your records.
  • Raising payment, set-off and any counterclaim where they apply.
  • Negotiating a schedule you can meet if something is genuinely owed.

Debt case lawyer Dubai: when you are the one being sued

On the debtor's side, the work runs in a different order from a creditor's: protect the deadline, test the documents, then decide whether to defend, settle or do both. Where a court case for unpaid loan instalments is pending, a negotiated outcome can still be possible alongside it, and a judgment can be appealed in appropriate cases within strict time limits that run from the judgment.

Ignoring a court summons

Ignoring a court summons is the single most common way a manageable claim becomes a harder one. A case can go ahead without you, and the result may then be enforced against you. If you have received papers you do not understand, they are still worth a call. If you are abroad, tell us at the first consultation, because a power of attorney may be needed for someone to act for you. See power of attorney notarisation.

Execution

Execution case lawyer Dubai: after a judgment or payment order

This stage begins once a judgment or order has gone against you and the creditor asks the court to enforce it. An execution case is a separate stage from the claim itself. It starts from the judgment or order, not from the original debt, so the first job is to read exactly what is being enforced.

Execution case Dubai: what it can involve

Where a court has given a judgment for money and the debtor has not paid, the creditor may ask the enforcement side of the court for measures. As we understand it, enforcement can include steps against a debtor's assets, which may include bank accounts, and a travel restriction can be among them. What applies to you depends on the order, the amount and the current law, so we establish exactly what has been listed against you.

Execution case against me: what you can do

If an execution case has been opened against you, the routes usually include:

  • Paying in full, if you can.
  • Agreeing a settlement or an instalment arrangement that the creditor records.
  • Applying, with supporting papers, where the order was made in error or the debt has already been paid.
  • Asking for advice on what is, and is not, open to challenge at this stage.

A restriction listed in the file usually stays until the file itself is dealt with in one of these ways. Whether the creditor accepts an arrangement is its choice, so we say honestly when an offer is unlikely to be taken.

If an execution notice has reached you. Call +971 4 570 0204 or send photos of the papers on WhatsApp. Do not transfer funds or assets away to avoid enforcement, because that can create a separate and larger problem.

Travel ban and freeze

Travel ban and frozen account: the two risks people ask about first

People with a debt problem usually ask two things: can I be stopped from leaving, and can my account be frozen. Both can follow a court case or an enforcement file, and both depend on the facts and the current law.

Travel ban for debt: loans and credit cards

A travel ban for debt is one of the situations where early advice most often changes the options. A court can impose a travel ban on a debtor in specified circumstances, but whether one is available in your case, on what conditions and at what stage depends on the law and the facts, so we assess it case by case and do not promise an outcome either way. A bank or creditor generally acts through a court case or a complaint to the authorities rather than imposing a ban itself, as we understand it, but the practical effect can be a restriction on leaving.

If you have fallen behind, ask for advice before you travel, and do not book a flight on the assumption that there is no ban. For how to check for one, how bans arise and how they are lifted, see our travel ban lawyer Dubai page. If you are worried about a travel ban for unpaid loan balances, tell us before you plan to leave.

Bank account frozen for debt

A bank account frozen for debt usually has one of a few causes: a court-ordered precautionary attachment connected to a claim, an enforcement file, or the bank's own review. A freeze can follow an execution file, and the route to release depends on which one it is. Where a creditor froze the account through a precautionary attachment, the dates on the order matter, and we check them first. For urgent freezes, see our bank account frozen lawyer page, which covers frozen accounts, called guarantees and bank disputes in detail.

Cheques

Cheques you issued: security cheques and bounced cheques

Many loans and cards come with cheques. If you gave the bank a security cheque for a loan, or a cheque you issued was returned, the cheque can create exposure of its own on top of the debt. We ask what the cheque was for, whether the debt behind it is owed and what has actually been filed.

I issued a cheque that bounced: what now?

If you issued a cheque that bounced, do not ignore a demand, do not sign an acknowledgement and do not hand over a replacement cheque before you have taken advice. As we understand it, since the 2022 changes a returned cheque is generally a civil matter that can be enforced directly through the Execution Court, and criminal liability remains only in specified cases such as fraud or bad faith. The position depends on the facts, so we confirm it at your first consultation. See our bounced cheque lawyer Dubai page for issuers and holders.

A security cheque for a loan

A security cheque for a loan was given to cover the debt, not to pay a particular instalment. How a security cheque is treated depends on the facts and on the evidence of what it secured. When a loan is settled or rescheduled, ask for the cheque to be returned or its position recorded in writing. If a criminal allegation of fraud or bad faith is made, see our criminal lawyer in Dubai and financial crime lawyer pages.

Guarantors

Personal guarantee lawyer Dubai: guarantors and co-borrowers

A personal guarantee lawyer in Dubai helps you understand your position when you signed for someone else's loan, or for your company's. Your exposure is set by the guarantee wording, not by how you feel about the borrower. A guarantee can sit alongside the borrower's own obligation, and a guarantee can be called independently of how the company is doing, so we read it before anything else.

Guarantor lawyer Dubai: what we check first

We start with the document you signed and the loan it supports. People searching "guarantor liability UAE" usually want to know how much they could be asked to pay. The answer depends on what the guarantee says it covers, for how long and on what conditions, so we ask these questions:

  • What does the guarantee cover: the whole debt, part of it, or a fixed amount?
  • Which facility does it support, and has that facility been changed since you signed?
  • Has the bank made a demand on you, and what exactly does it say?
  • Does it continue if you leave the company or the borrower's circumstances change? That depends on the wording.
  • Can you negotiate separately with the bank, and can a settlement of the main debt release you?

Personal guarantee loan UAE: if you are a co-borrower

A personal guarantee on a loan in the UAE is different from being a co-borrower, but both can leave you answerable to the bank. If you are asked to sign a settlement, ask whether it releases you in writing. Do not assume that a deal agreed by the main borrower covers you.

Signed as a guarantor and now being asked to pay? Send us the guarantee and we will explain your position before you speak to the bank. Your first consultation is free and confidential.

Companies and owners

Company debt and personal liability in the UAE

A company is generally a separate legal person from its owners, so its debts are usually its own. In practice, personal exposure often arrives through a guarantee, a cheque signed personally or the way directors acted before the company ran into trouble. We act for companies in free zones, the DIFC and the ADGM as well as on the mainland, and the route that applies depends on where the company is established.

Company debt: who may be exposed, in general terms
Source of exposureWhy it mattersWhat we check
The company itselfIt is the borrower under the facilityThe facility terms, the security and what the lender has demanded
A personal guarantee from an owner or directorIt stays with the person who gave it, whatever happens to the companyThe wording, the amount covered and the facility it supports
Cheques or undertakings signed personallyThey may be enforced against the person who signedWho signed, in what capacity, and what each was for
Director conduct before insolvencyDirectors and managers can face questions about earlier decisionsRecords of decisions, payments and assets

Personal liability for company debt depends on the company, the conduct and the current law. Director liability for company debt can arise where a guarantee or a personally signed cheque is involved, and, as we understand it, directors and managers can face personal exposure if the company later goes bankrupt, with a reported two-year look-back on earlier transactions. We confirm the position with you before you rely on it.

Insolvency lawyer Dubai: preventive settlement and the other routes

An insolvency lawyer in Dubai looks at the routes open to a company that cannot pay its debts. Many directors first search for "preventive settlement UAE", and it is one of those routes. As we understand it, Federal Decree-Law No. 51 of 2023 provides three court-supervised routes: preventive settlement, restructuring and bankruptcy. A preventive settlement can be sought by the debtor alone and carries a reported moratorium of three to six months. Availability depends on the company, where it is established and its debts, and, as we understand it, the law excludes DIFC and ADGM companies, which have their own regimes. We assess this with you and do not assume it.

Routes for a company that cannot pay, in general terms
RouteWhat it isPoints to watch
Agree terms with lendersRescheduling, a pause on payments or a settlement negotiated with the bankGet it in writing, and check that it covers every creditor that matters
Court-supervised proceduresPreventive settlement, restructuring or bankruptcy, where availableAvailability depends on the company and where it is established
Closing the companyVoluntary or compulsory liquidationClosing a company does not remove a personal guarantee. See company liquidation lawyer Dubai

If the company is also short of money to pay staff or landlords, those problems often arrive together with the bank's. Our company liquidation lawyer page covers closure, and our corporate and commercial lawyer page covers owners' and shareholders' questions.

What directors should do while the company is struggling

  • Keep complete and accurate records of decisions, payments and assets.
  • Do not move assets, favour one creditor or pay yourself ahead of creditors without advice.
  • Review every personal guarantee, cheque or undertaking you signed.
  • Tell the owners in writing about the company's position.
  • Take advice before signing anything new in the company's name.
Collection calls

Debt collection agency calls and letters

Debt collection calls usually begin once a debt has been unpaid for some time. People often search "debt collection agency UAE" to find out who is calling. An agency may be acting for the lender or for another party, and we do not assume which. A collector can tell you what is claimed, but a collector does not change what you owe, and a call is not a court order.

What to do when a collector calls

  • Ask who the creditor is, the amount claimed and how it is made up, and ask for it in writing.
  • Keep a record of dates, times, numbers and what was said.
  • Do not give card details, sign anything or pay on the call.
  • Do not agree to a payment plan until you know what the payment settles.
  • If a caller threatens a criminal case or arrest, do not panic and do not pay on the call. Send us what was said. Whether any criminal question exists depends on the facts, for example a returned cheque.

Collection agency, or lawyer?

A collection agency chases payment. A lawyer can also take formal steps, such as answering a claim, objecting to a payment order, negotiating a written settlement and dealing with an execution file. If a bank or collector treats you unfairly, as we understand it the Central Bank of the UAE oversees banks and has a consumer complaints route for how a bank has treated you. We confirm the current process at your first consultation.

Avoid these

What not to do when you owe money

Most debt problems get worse through a handful of avoidable mistakes. None of them is a reason to feel ashamed, but each is worth knowing before you act.

  • Ignoring papers. An unanswered claim or payment order can end in a judgment you could have contested.
  • Moving assets. Transferring money or property to a relative to keep it from a creditor can create a separate problem and may be challenged.
  • Signing an acknowledgement of debt. An acknowledgement can be treated as written proof of the debt, so read it with a lawyer first.
  • Handing over a new cheque. A replacement cheque can create a fresh problem.
  • Paying an unverified collector. Confirm who is entitled to the money, and what the payment settles, in writing.
  • Accepting the first settlement offer without reading it. Check that it is full and final, and what happens to cheques and guarantees.
  • Borrowing from one lender to pay another without advice. It can deepen the problem and add a new creditor.
  • Leaving the country and hoping it goes away. A case can continue in your absence, and a restriction or an enforcement step may be waiting for you.
  • Stopping all contact with the bank. Silence closes options. A short written proposal keeps them open.
  • For a company: paying some creditors ahead of others. Directors may face questions about the order of payment later.
How it works

How MBM handles a debt settlement or defence

Every matter starts with understanding the debt, not with a template. You will always know where your matter stands.

  1. Step 01

    Free first consultation

Tell us what you owe, who to, and what you have received. We explain the likely route and the sensible first step, in confidence, by phone, WhatsApp or at our Dubai or Sharjah office.

  2. Step 02

Read the papers and protect the dates

We read the agreement, the statement and anything served on you, and diarise every deadline before anything else.

  3. Step 03

    Written scope and fee position

Before you instruct us, we set out what the work covers, what it costs and what is billed separately, such as court fees and translation.

  4. Step 04

    Negotiate or defend

We put a settlement or rescheduling proposal to the lender, or answer the claim, or both together. You see every offer and every reply.

  5. Step 05

    Deal with the linked problems

Cheques, guarantees, a freeze, a travel concern or collector calls are handled alongside the main debt, not separately.

  6. Step 06

    Record the outcome in writing

A settlement, a judgment or a withdrawal is confirmed in writing, including the return of cheques, the release of guarantees and the closing of the account or execution file.

Before you call

What to have to hand

You do not need all of this to make the first call. If a claim, payment order or execution notice has been served on you, call first and gather documents afterwards.

  • The loan, card or facility agreementWith any amendments, and the key terms on interest, fees and default.
  • Recent statementsAnd, if you can get one, a statement of the amount the lender says you owe.
  • Anything served on youA demand, default notice, claim, payment order or execution notice, and the date it reached you.
  • Correspondence, messages and call recordsWith the bank, the collector or anyone acting for them.
  • Cheques and guarantees you gaveCopies of cheques, and the guarantee if you signed one.
  • Any settlement offerMade by you or by the lender, in writing if there is one.
  • A short note of your income and outgoingsSo we can judge what a realistic plan looks like.
  • For a company: the trade licence and recent accountsAnd details of who signed the facility and any guarantees.
  • Your Emirates ID or passportAnd your visa details if you are a resident.
Timing

How long does it take? Honest timelines

How long a debt matter takes depends on the route, the lender and whether anything is disputed, so we do not quote a standard time and promise nothing. A settlement with a lender willing to talk can be quick. A contested claim with a judgment and an execution file is a longer process.

What usually makes a debt matter faster or slower
Faster whenSlower when
The lender is willing to negotiate and has a clear statementThe amount, the interest or the charges are disputed
You respond to papers at onceA deadline was missed and has to be recovered
The documents are completeAgreements, statements or cheques are missing
One lender and one debtSeveral lenders, guarantees and a company involved
A settlement is in writing and signedThe terms are agreed on the phone and later disputed

After reviewing your papers we give you an indicative picture of your own matter, in writing, and we update it as it develops.

Fees

How fees work

Your first consultation with MBM is free and confidential. If you decide to instruct us, we first give you a written scope and fee position, so you know what is covered before any paid work starts. We do not publish a price list, because the work differs widely between a single card settlement and a company facility with guarantees behind it.

  • What drives the fee. The number of debts and lenders, whether a claim is already filed, whether the amount is disputed and whether a company or guarantees are involved.
  • Separate from our fees. Any amount you agree to pay the lender, court fees, translation and other third-party charges are separate. We tell you which are likely to apply.
  • Honest about value. If a defence has little to argue, we say so and turn to the settlement you can realistically reach.

Why MBM

Why borrowers and business owners ask MBM

When you owe money, you want someone who will read the papers calmly, explain your position plainly and not judge. That is how we work. MBM acts as both lawyers and legal consultants, so we can advise on a settlement and, if it becomes a claim, answer it, with litigation and arbitration handled by the same team.

Evidence, not slogans

Rated 4.9 on Google reviews. MBM is founder-led, by Mohamed Badr, Founder & Managing Partner, who has 17 years of legal experience. You get a written scope and fee position before work starts, plain-language explanations, confidentiality from the first call and one team from the first letter to the end of the matter. MBM works with group companies in the UK, Europe, the Middle East and the Gulf, which helps when a borrower, a guarantor or assets are abroad. Our lawyers and legal consultants are experts in UAE debt, banking and enforcement matters, with a high success rate in the matters we handle; no outcome is promised in any individual case.

Both sides of the ledger

We act for creditors and for debtors, so we know how a bank prepares a claim and how a defence is built. That helps in settlement talks, because we understand what the other side will accept and what it will not.

No promises on outcome

Lenders decide for themselves what they will accept, and courts decide claims on the evidence. No outcome is guaranteed. We tell you where your position is strong and where it is weak before you commit.

Common questions

Debt settlement and loan default in the UAE: your questions answered

General information on debts owed to banks and lenders in Dubai and the UAE. It is not legal advice. Positions and procedures change and depend on your documents, so please contact MBM to discuss yours.

What does a debt settlement lawyer do in Dubai?

A debt settlement lawyer reads your agreement, the lender's statement and whatever has been served on you, then helps you decide between settling, rescheduling, defending or a combination. We negotiate with the lender, put proposals and agreements in writing and answer any claim, payment order or execution file. MBM's first consultation is free.

What happens if I default on a loan in UAE?

It depends on the loan agreement, the lender and the amount. Lenders commonly begin with reminders and a formal demand. As we understand it, a lender that is owed money can seek a payment order and then enforcement through the execution process. Tell us what you have received and we explain which stage you are at and what is still open.

A bank filed a case against me. What should I do?

Keep the papers, note the date they reached you and call a lawyer before you reply. A claim is not the same as a debt you owe: the amount must be shown and the documents must establish it. We protect the deadline first, then test the claim and look at defence and settlement together. See bank claims on this page.

Can a bank sue me for an unpaid loan in Dubai?

Yes, a lender can bring a claim for money it says is owed. Whether the claim is right, and for how much, is a separate question. We check the amount against the agreement and your records, and we tell you honestly whether there is something to argue or whether settlement is the better route.

How to object to a payment order in UAE courts?

A payment order is a fast-track procedure for a creditor with clear written proof, and, as we understand it, it arises under the Civil Procedure Law (Federal Decree-Law No. 42 of 2022). The window to respond is short and runs from service, so note the date it reached you and call at once. The objection must be raised properly and in time, and it should address whether the debt is owed, the amount, any payment made and whether the documents prove the claim.

Can I negotiate with my bank to settle a debt?

Often yes, and it is usually better to start before an enforcement file exists. The bank decides what it will accept, so we put a realistic proposal in writing, keep a record of every reply and make sure that what is agreed is what is recorded. No settlement is guaranteed.

Can a lawyer reduce or cancel my debt?

We cannot promise that, and anyone who does should be treated with caution. What a lawyer can do is check how the balance was built, test whether the claim is right, negotiate terms and make sure any agreement is clear. Whether any part of a balance can be questioned depends on the agreement and the law.

What is the difference between settlement, rescheduling and restructuring?

A settlement closes a debt on agreed terms, often by a lump sum or instalments. Rescheduling keeps the debt but changes the timing. Restructuring changes the facility itself, its security or several debts together. Which suits you depends on your income, the amount and what the lender will accept.

I am unable to pay credit card bills in full. What should I do?

Do not ignore the statements or the calls. Get a full statement and the card agreement, find out whether anything has been filed, decide what you can genuinely pay and put a proposal in writing. Do not pay anything until the terms are written down and you know what the payment settles.

How to settle credit card debt in UAE?

There is no single route, but the order of work is usually the same: check the balance, check for any claim, decide a realistic figure and put a written proposal to the bank. A written settlement should say which debt it covers, whether it is full and final, how it is paid and that the account will be confirmed closed once the payments are made.

What happens to the cheques I gave the bank?

Cheques or other instruments given as security can create exposure of their own. When a loan is settled or rescheduled, ask for the cheque to be returned or its position recorded in writing. See our bounced cheque lawyer Dubai page if one has been returned.

Can I be stopped from leaving the UAE because of a loan or credit card debt?

A court can impose a travel ban on a debtor in specified circumstances, but whether one is available in your case depends on the law, the facts and the stage of the matter. A bank generally acts through a court case or a complaint to the authorities rather than imposing a ban itself, as we understand it. If you have fallen behind, get advice before you travel. See travel ban lawyer Dubai.

How can I find out whether I have a travel ban for debt?

As we understand it, there are online checks for financial cases in Dubai, but they do not cover every kind of ban, such as a criminal or immigration restriction or one recorded in another emirate. A lawyer can often make the enquiry on your behalf. Please do not book a flight into or out of the UAE on the assumption that there is no ban.

Can the bank freeze my account because of a debt?

A freeze can follow a court-ordered attachment connected to a claim, an enforcement file or the bank's own review. The route to release depends on which it is, so we establish the basis first. See bank account frozen lawyer.

What is an execution case, and what can happen in it?

An execution case is the enforcement of a judgment or order, and it is a separate stage from the claim itself. As we understand it, enforcement can include steps against a debtor's assets, which may include bank accounts, and a travel restriction can be among them. What applies to you depends on the order and the current law.

Can I pay by instalments in an execution case?

Often the practical route is a settlement or instalment arrangement that the creditor records. Whether the creditor accepts one is its choice. We negotiate it, make sure it is in writing and say honestly when an offer is unlikely to be taken.

I signed a personal guarantee. Can the bank claim from me?

It depends on the wording of the guarantee, what it covers and the facility it supports. A guarantee can sit alongside the borrower's own obligation. Send us the guarantee and any demand, and we explain your position before you speak to the bank.

My company defaulted on a loan. Am I personally liable?

A company is generally a separate legal person, so its debts are usually its own. Personal exposure can still arise through a personal guarantee, a cheque you signed personally or the way directors acted before the company ran into trouble. It depends on the company, the conduct and the current law, so we confirm your position before you rely on it.

Can I close my company to get rid of its debts?

As we understand it, that is not safe. Cancelling a licence does not cancel the company's debts, creditors may still claim and anything personally guaranteed stays with the person who gave the guarantee. See company liquidation lawyer Dubai.

What is a preventive settlement in the UAE?

As we understand it, a preventive settlement is one of the court-supervised routes for a company in financial difficulty under Federal Decree-Law No. 51 of 2023, and it can be sought by the debtor alone with a reported moratorium of three to six months. Availability depends on the company and where it is established, and the law excludes DIFC and ADGM companies as we understand it. We confirm the position first.

Is there personal bankruptcy in the UAE?

The insolvency framework has been reformed in recent years, and what is available to an individual, as opposed to a company, depends on the person's status and the current law. We do not assume that any route is open to you. We assess it with you at the first consultation.

Do I have to speak to debt collectors?

A collector can tell you what is claimed, but a call is not a court order and a collector does not change what you owe. Ask in writing who the creditor is and how the amount is made up, keep a record of every call and do not pay or sign on the phone. Send us what was said if a caller threatens a criminal case or arrest.

What happens if I ignore a court summons or the bank's claim?

A case can go ahead without you, and the result may then be enforced against you. Papers you do not understand are still worth a call. If you are abroad, tell us at the first consultation, because a power of attorney may be needed for someone to act for you.

Can the bank keep charging interest and fees after a default?

That depends on the agreement and the law. We ask for a full statement and compare it with the contract. Whether any part of the balance can be questioned depends on both, and we do not promise that any amount will be reduced.

Does MBM act for companies in free zones, the DIFC and the ADGM?

Yes. We act for companies in free zones, the DIFC and the ADGM as well as on the mainland, and for matters before the DIFC Courts. Which forum and which rules apply depends on the company and the agreement, and we explain that at the first consultation.

Can I complain to the Central Bank about my bank?

As we understand it, the Central Bank of the UAE oversees banks and has a consumer complaints route for how a bank has treated you. That is separate from the question of whether you owe the debt. We confirm the current process at your first consultation.

How long will a debt settlement take?

It depends on the route, the lender and whether anything is disputed, and no timeline is promised. A settlement with a willing lender can be quick. A contested claim with a judgment and an execution file takes longer. After reviewing your papers we give an indicative picture in writing.

How much does a debt settlement lawyer cost in Dubai?

It depends on the number of debts and lenders, whether a claim is filed and whether a company or guarantees are involved. MBM does not publish a price list. We give you a written scope and fee position before you instruct us, and any amount you pay the lender is separate from our fees. The first consultation is free.

Is the first consultation really free?

Yes. MBM's first consultation is free and confidential. It is a discussion of the debt and your options. If you then want MBM to act for you, you receive a scope and a fee position in writing before any paid work starts.

Can anyone promise the outcome of my debt matter?

No. No responsible law firm can promise that a lender will accept a settlement or that a claim will be dismissed. MBM's role is to read your papers, act promptly, negotiate or defend on the facts and tell you honestly what is realistic.
